Unless you want to use the adultery as evidence of his irresponsibility as a parent -- which is a reach if there are not other problems with him as a father -- then adultery will rarely get you more money. If you do not have kids I would go for the uncontested route and get it over with.
Sorry this is happening to you.How to get evidence for a divorce! Need some advice !?
First, make sure you can even file divorce on the grounds of adultery in the state you live in. Not every state allows it.... alot of states only allow filing on the grounds of irreconcilible differences.
So get that info then go from there.
The courts don't even look at adultry in a divorce any more unless it's a marriage that involves ';$$$millions$$';.
They call it ';Irreconsiable Differences';.
Your obsessing. You asked this yesterday too.
Move on
I've heard that they require a confession from him.
You are going to haev to get all ';hollywood'; on him, confront him about it, and record it secretly. I think that would guarantee a better than good outcome for you....
If you really want a divorce, go for the easiest route. Why entertain unnecessary drama by bringing adultery into it. Get an attorney and get on with it (if you are serious).
I don't think you will even need any evidence. You should just call a lawyer explain this... I think you can just file with no problems. Sorry for your situation!
Divorce can be very expensive if you go the contested route. When you both retain lawyers, their job is to do everything they can to support your case. Unfortunately, this takes time (often several extra months to the minimum time to complete a divorce in your state) and a lot of money (think $10,000 for each of you or more if you have a lot of stuff).
Definitely consider going the uncontested route. You can get it done faster and save both of you money. Just see if you can agree to who gets what, and you may be able to get some forms at your county courthouse if your case is simple. If your case is more complicated, you can look for online divorce document preparation service that will provide you with all of the completed forms or go through a divorce mediator.
(If you live in NY, you still might want to get evidence of adultery; it's the one U.S. state that does not have a no-fault divorce; but even if you do this you still may be able to work with your husband to get the divorce done as easily as possible).
