correct u mundo!! there isnt such a thing as a military divorce. as the old saying goes??? if the military wanted you to have a wife they would have issued you one!! best to go to a civilian attorney and get some legal advice on what to do. fo the most part the military will stay out of the divorce and seperation process. now the one exception is that once a divorce decree is issued and you are ordered to pay child support or spousal support. if you fail to do so then you can be in violation of the ucmj and face the music. so my advice is if you can work it out do so, or otherwise get the hell out of the military, because your spouse will have you by the balls as long as you are in uniform. she only has to call your commander to complain and you will be standing tall before the man.Any advice on Military Divorces? I understand it goes by your home state?
I am in the middle of one my soon to be ex told me that if your spouse is stationed in a different state and they serve you papers then the divorce is settled there. And you can go to JAG and get advice but you better go first if you dont and your spouse goes first then JAG will not help you because they are helping them. But I was told lets say your spouse is a Marine if you go to an Army base then you can get advice from JAG there. Or even if you are the one in the military. If there are children involved they do that by where the child has lived for the last 6 months. JAG will not do a divorce but will give legal advice on what to do.Any advice on Military Divorces? There is no such thing as a military divorce. The military legal system deals with the UCMJ but not civil divorces. A divorce is handled by the civilian court of your home jurisdiction. The question of what is the proper jurisdiction can get a little hairy if the parties don't agree on jurisdiction.
